These Terms of Service ("Terms") govern your use of ScheduleEveryCall.com's phone answering, scheduling, and messaging services (the "Service"). ScheduleEveryCall.com is operated by Open Market Stack LLC, doing business as Apairta and as ScheduleEveryCall.com ("we," "us"). By calling one of our phone lines, exchanging text messages with us, submitting a form on this site, or otherwise using the Service, you agree to these Terms.
What the Service is
ScheduleEveryCall provides an AI-based phone answering and appointment-scheduling assistant that home and field service businesses ("Customers") use to handle calls they can't answer themselves. If you're calling a business that uses ScheduleEveryCall, you may be speaking with our automated assistant rather than a human employee of that business.
Calls may be recorded and transcribed for the purposes described in our Privacy Policy. Continuing a call after being informed it may be recorded, or proceeding to book an appointment, constitutes your consent to that recording where consent is required by law. If you do not consent, please ask to be transferred to a human representative or contact the business directly by another means.
No guarantee of outcomes
The Service is provided to help route calls and schedule appointments. We don't control, and aren't responsible for, whether a Customer business actually completes a job, honors a quoted price, or shows up at a scheduled time — that relationship is between you and the business you're contacting. Appointment slots, fees, and availability quoted by the assistant are provided by the Customer business and are estimates, not guarantees.
SMS messaging
If you provide a mobile number and communicate with us by text, you agree to receive SMS messages related to scheduling and service updates, as described in our Privacy Policy. Message and data rates may apply. Reply STOP to opt out at any time, or HELP for assistance.
Acceptable use
You agree not to use the Service to:
- Provide false information with intent to defraud a Customer business or waste emergency-dispatch resources.
- Attempt to interfere with, disrupt, or gain unauthorized access to the Service or its underlying systems.
- Use the Service for any unlawful purpose.
For Customer businesses (subscribers)
If you're a business using ScheduleEveryCall to answer calls for your company:
- Subscriptions are billed as agreed at signup, month-to-month with no long-term contract, and may be canceled at any time effective at the end of the current billing period.
- You are responsible for the accuracy of the business information, pricing, and policies you provide us to configure your assistant, and for complying with any laws applicable to your business (including call-recording consent laws in your area).
- Founding pricing, free-trial periods, and similar promotional terms are as stated to you at signup and may be limited to a specific number of participating businesses.
Disclaimer of warranties
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that every call will be handled perfectly — it's an automated system and can make mistakes.
Limitation of liability
To the fullest extent permitted by law, Open Market Stack LLC and its DBAs (Apairta, ScheduleEveryCall.com) will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Service, whether based on warranty, contract, tort, or any other legal theory, even if advised of the possibility of such damages.
Governing law
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws principles.
Changes to these Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent version. Continued use of the Service after a change means you accept the updated Terms.
